Personal injury” is a very broad category of civil tort law.  It includes cases where an individual has sustained some sort of physical injury due to the negligence of another.  Common examples include car accidents, slip and falls, work related injuries, defective products, medical malpractice and more.  However, not all personal injury attorneys handle every type of case.  Be sure to check the practice areas on each attorney’s website to determine which types of personal injury cases they handle.

It is best to call a personal injury attorney as soon as possible after an accident. Every personal injury case is different.  No lawyer can, or should, tell you how much your case is worth at the beginning.  And if they try to tell you, be wary of the attorney’s real intentions.  There are just too many variables that go into what a personal injury case is worth.

The typical statute of limitations for a personal injury case is two years.  That means the injured party has two years from the date of the accident to either settle or file the lawsuit.  But it’s never smart to wait.  You must start gathering evidence, contacting witnesses and getting medical treatment as soon as possible.  That is why it is always better to get a lawyer early who can start working on your case right away.

The time it takes to settle an injury case varies.  First, your case is not even sent to the insurance adjuster until after being released from treatment.  Second, your attorney will gather your medical records and bills for the adjuster to review.  And third, it takes another 2 weeks or so to get an offer from the adjuster and start negotiations.  If negotiations are not successful, then your attorney will have to file a lawsuit.  This will delay your case even further.  But sometimes litigation is necessary to get a fair settlement.
