How long do I have to file my case?
The typical statute of limitations for a personal injury case is two years. That means the injured party has two years from the date of the accident to either settle or file the lawsuit. But it’s never smart to wait. You must start gathering evidence, contacting witnesses and getting medical treatment as soon as possible. How long does it take to settle an injury case?
The time it takes to settle an injury case varies. First, your case is not even sent to the insurance adjuster until after being released from treatment. Second, your attorney will gather your medical records and bills for the adjuster to review. And third, it takes another 2 weeks or so to get an offer from the adjuster and start negotiations. If negotiations are not successful, then your attorney will have to file a lawsuit. This will delay your case even further. But sometimes litigation is necessary to get a fair settlement.
