Can I be liable If my son was also on my insurance?

Question:  My son lives with me.  He is an adult and has his own car in his name.  He was just involved in an accident.  Am I also responsible since he is also on my auto insurance?

Answer:  The short answer is “no.”  What you are describing is a claim for negligent entrustment.  Under such a claim, the owner of a vehicle may be responsible if they lend their vehicle out to someone who they know is either an incompetent or unlicensed driver, and that person causes and accident.  It does not matter that the driver was under your insurance.  The main issue is “who is the owner” of the vehicle.  If you are not the owner, then you cannot be responsible for negligent entrustment.
